3. I don't have an e-mail address — can I still apply?
Both during and after the application process, CPCC will correspond with zero-rating program participants by e-mail. Those who do not have an e-mail address are advised to set up an e-mail account through their Internet service provider, or through a free Internet-based e-mail service, such as Hotmail or Yahoo, before proceeding with an application. If you cannot access a computer or the Internet, call the toll-free hotline (1-866-886-0232).

4. What is the fee to participate?
The administrative fee for commercial businesses is $60, and $15 for non-commercial organizations, plus GST or HST. There is no fee for legislatively exempt purchasers. Payment must be made online using a valid VISA, MasterCard, American Express, or Discover credit card at the end of the online application process.

6. How do I know if I am authorized to enter the agreement on my organization's behalf?
This will vary from organization to organization, and is subject to CPCC's agreement. Before beginning the application process, you have the opportunity to print out a sample contract. Review the terms and conditions carefully. If you are still not sure whether you have the authority to enter into such an agreement, show the contract to your legal counsel, and/or to the individual who has cheque-signing authority.

If the only entity authorized to enter the zero-rating agreement with CPCC is not based in Canada, that entity may enter into the agreement if it is registered to do business in Canada. However, a Canadian contact (including mailing address and telephone number) must be provided in the application, and zero-rated purchases may only be made by the specified Canadian entity registered to do business in Canada.

If the only individual authorized to sign the zero-rating agreement on your business/organization's behalf is not in Canada, that individual may sign the contract on your behalf. However, a Canadian contact (including mailing address and telephone number) must be provided in the application, and zero-rated purchases may only be made by the specified Canadian entity.

7. Can more than one employee or member of my business / organization enter an agreement?
Yes. Your business / organization may wish individual departments, branches, etc. to participate independently from each other. Each will need to complete its own application and payment, and each application will be considered independently from the other(s).

8. I don't know if my business / organization is incorporated or registered.

If the full legal name of your business ends with the following, it is likely incorporated: Incorporated, Incorporée, Inc., Limited, Ltd., Limitée, Ltée, Corporation, Corp., Professional Corporation, Société professionnelle, Société par action de régime fédéral, S.A.R.F., Société commerciale canadienne, S.C.C.

As a minimum, applicants must provide the full legal name of the business or organization, and indicate whether it is a commercial or non-commercial entity. If you cannot provide further details on the status of the business / organization, you may still be eligible, but the processing of your application will be delayed.

9. My business / organization was incorporated in another country. Are we still eligible?
In order to be eligible, an applicant must have a permanent establishment located in Canada and be registered to do business in Canada, either provincially or federally. In these instances, please note that zero-rated purchases may only be made by the specified Canadian office/entity registered to do business in Canada. Authorized officers of the Canadian entity residing outside of Canada may execute the zero-rating agreement. However, a Canadian contact (including mailing address and telephone number) must be provided in the application.

When your application has been processed, CPCC will contact you by e-mail to notify you whether the application is approved or rejected, or if more information is required.

18. What if my application is rejected?
You will receive an e-mail from CPCC, which will specify the deficiency(ies) in your application. If you wish to pursue the application further, you will need to provide or correct the specified information within ten business days. If no response is received from you within the ten business days, any payment you may have made will be refunded. If you wish to re-apply after the ten days have elapsed, you will need to complete a new application.

21. How secure is the online application form?
Secure software and procedures are used to protect all information (data) provided by applicants. The data is stored in a database that runs in stealth mode, making it inaccessible directly from the Internet. The CPCC Internet server is physically located in an environment controlled by security systems and movement detectors. Credit card payments are carried out by a specialized third party.

CPCC may revise this privacy policy from time and time. Such changes will be posted at the affected website(s).

When and how CPCC collects information about your organization

You may access and read the Canadian Private Copying Collective's ("CPCC") websites without giving CPCC any information that identifies you. However, if your business, non-profit organization, government department, government agency, Crown Corporation or public institution (henceforth, your "Organization") is seeking registration to buy certain blank audio recording media on a royalty-free basis, CPCC will ask you to provide information about your Organization by filling out and submitting an online application form. That form will request certain information about your Organization, including your Organization's name, Canadian mailing address, your name and title, phone number, fax number, e-mail address and other information regarding your Organization and its use of blank audio recording media. It is completely optional for you to fill out the form and/or for your Organization to seek to participate in this program (the "Zero-Rating Program"). Please bear in mind that should you choose not to provide the requested information, it may not be possible for your Organization to participate in the Zero-Rating Program.

Why CPCC collects information about your organization

CPCC collects information with the form in order to determine whether your Organization is eligible to participate in the Zero-Rating Program as well as to record and support your participation in the program. Further, where applicable, your Organization may be required to use a credit card to pay CPCC an administrative fee to be registered in this program, and you may be asked to provide a card number, expiration date and name of the cardholder.

When CPCC discloses information about your organization

CPCC may share this information with third parties contracted by CPCC to store or process your Organization's information. Subject to the terms and conditions of any agreement between your Organization and CPCC, CPCC does not share information about individuals within your Organization or about your credit card details (except as required to process payment or for enforcement of the Zero-Rating Program).

CPCC does not sell lists of individuals' names to any outside establishments.

Personal information

CPCC does not seek to collect personal information through the application form for the Zero-Rating Program. Those seeking registration in the Zero-Rating Program must be Organizations. The name, title and other business information requested in the application process are not gathered, nor does CPCC intend, to collect personal information about you or others in your Organization.

How CPCC protects information

Information collected during the application process by your Organization at the CPCC websites is protected to prevent unauthorized access to it. Click here to learn how. Should any application be abandoned or not accepted, the information provided is eventually erased.

Changing your information

Once your Organization is registered in the Zero-Rating Program, you may (and your Organization will be required to) update and correct any information regarding your Organization provided to CPCC in the application process. Click here to learn how.

Making royalty-free purchases
23. Where can I make royalty-free purchases?
Purchasers will only be able to buy zero-rated media from distributors that have been certified by CPCC. Not all distributors are expected to participate. Fifty companies participated in the original program. This number is expected to increase with expansion of the program to encompass CD-R, and CD-RW. It will not be possible to buy zero-rated media through retail stores.

The following is a list of distributors currently registered under the new zero-rating program to sell zero-rated media royalty free to holders of valid zero-rating certificate numbers. This list will be updated as new distributors become certified.

24. How do I make royalty-free purchases?
You will need to provide your valid certificate number for verification each time media are acquired royalty free.

Certified distributors are obligated to make reasonable efforts to verify the validity of a certificate number, and the identity of the buyer using it, each time they sell media royalty free.

26. Can anyone use my certificate number to purchase media royalty free?
Participants are required to make reasonable efforts to avoid the disclosure of their certificate number to third parties. Certified distributors are obligated to make reasonable efforts to verify the validity of a certificate number, and the identity of the buyer using it, each time they sell media royalty free.

Certified buyers and distributors are all obligated to report any suspected misuse of zero-rating certificate numbers. Please report suspicious activity that comes to your attention to CPCC by e-mail (buyers@cpcc.ca) or telephone (1-866-886-0232).

Online Reporting and Renewal Process
28. When do I have to report my royalty-free purchases?
Reports are due in the 30 days before the date your one-year zero-rating contract expires. The CPCC will send a notice by e-mail to remind you when your report is due.

29. What information has to be reported?

According to paragraph 8(b) of your zero-rating contract, reports must include the following information on each purchase of royalty-free media: the name of the distributor(s), the date(s) of the purchase, and the type(s) and quantity(ies) of media purchased.

You will also have the opportunity to report and pay the levy for any media you purchased royalty free which were later used in ways that are not permitted under the terms of your contract (e.g. for personal use, or re-sold blank)..

30. How do I submit my report?
Reports must be submitted using the on-line reporting form provided by the CPCC. A link to the form will be emailed to you when your report is due.

31. How do I renew my contract and certificate number?
Immediately after you complete your purchase report, in the same on-line session, you will be invited to renew your contract and certificate number. If you choose to renew, you will be asked to confirm or update the information you supplied in your application about the registered business/organization and contact person, and pay the applicable administrative fee. You do not need to complete a new application form. If you choose not to renew, your contract and certificate number will expire.

Exemption for the perceptually disabled
35. Do societies, associations, or corporations that represent the perceptually disabled need certificate numbers to buy zero-rated media royalty free under the new program?
No. Societies, associations, or corporations that represent the perceptually disabled are still legislatively exempt from payment of royalties on all blank audio recording media. However, to facilitate access to the exemption, exempt buyers may register with CPCC for the zero-rating program before they buy media royalty free. Most exempt buyers already have a zero-rating contract with CPCC, and do not need a new certificate number. Their existing buyer certificate numbers will remain in effect under the new program.

Exempt organizations that do not have a zero-rating certificate number are encouraged to contact CPCC directly to obtain a number: this will make royalty-free purchases easier in future.
